Warranty and Returns

1. Product Description
The OpenAir Breathe product is comprised of the OpenAir Breathe Device and the OpenAir Breathe App. The OpenAir Breathe Device measures your lung flow by analysing the pressure of your breath and the OpenAir App provides you with insights and input with respect to such measurements. Through the Website, at https://www.openairmed.com/shop, we offer you to purchase the OpenAir Breathe Device and other accessories or auxiliary services and products(collectively with the OpenAir Breathe Device and a subscription to the OpenAir Breathe App the "Products"), at a price presented to you at the time you complete the purchase through the Website or through the OpenAir Breathe App (as applicable). We may occasionally change the prices of Products at our sole discretion. Please note, most benefits of the OpenAir Breathe Device may only be exercised when coupled with a valid subscription to the OpenAir Breathe App.
2. Order, Shipment and Delivery
You must be a minimum age of 18 years of age to submit an order for the OpenAir product. In case the order is made for a child under the age of 18 years of age, such order is at its parent's or legal guardian's responsibility. Payment shall be made through the Website in accordance with our terms of use. Delivery of orders will be made to the address that appears on your order within a reasonable time, however, there may be delays due to external factors. The time of delivery can vary depending on the destination. Free shipping of Products is available within certain territories as further displayed in the Website. Shipping costs will be added to the purchase price and charged either by OpenAir or our third party shipping services providers, as displayed to you up on ordering. Please note that additional local taxes may be applied to shipments to certain locations depending on your requested location for delivery. We will not refund or exchange Products that were shipped to an inaccurately inputted address. Shipping claims must be made within 45 days from the date of the shipping.
3. Limited One (1) Year Warranty Policy
OpenAir offers a one (1) year warranty on the hardware, pursuant to which OpenAir warrants that the hardware will materially conform to its specifications as provided to you in writing upon your purchase and that it will be free of material defects in materials and workmanship. This warranty specifically excludes damage caused from mishandling of the OpenAir Breathe Device and any other damage caused as a result of user’s non-compliance with the OpenAir Terms of Use or otherwise from any incautious use, e.g. water damage or dropping it. To exercise the above stated warranty, you must first contact OpenAir at support@Openairmed.com with a description of the warranty event and a proof of purchase. Once OpenAir confirms in writing that your product is covered under this warranty policy, you will be required to send the defective product to OpenAir or according to OpenAir’s instructions, and such product will be either fixed or replaced. The warranty for the replaced or fixed products shall be for the longer of: (i) three (3) months, or (ii) the period of warranty remaining to your one (1) year warranty with respect to the original product. OpenAir shall bear the malfunctioning and replacement products’ shipping costs that are associated with exercise of the warranty provided hereunder. Depending on where you live, the time it may take for your exchanged or replaced product to reach you, may vary.
4. Return and Refund Policy
We are confident that you will enjoy the OpenAir Breathe Product. However, according to our Return Policy, if you are not completely satisfied with your OpenAir Breathe Device, you are entitled to return your OpenAir Breathe Device and receive a refund subject to compliance. To be eligible for a return and refund, (i) you must notify us in writing sent by e-mail to support@Openairmed.com of your wish to cancel your purchase and return your OpenAir Breathe Device, within 14 days of date the OpenAir Breathe Device was delivered to you or to your address, as documented by the applicable shipping and delivery agent, together with a receipt or other proof of purchase, (ii) you must return the OpenAir Breathe Device to OpenAir’s address at your own cost within 14 days of your written notice of return, and (iii) your item must be returned to OpenAir in the same condition that you received it. It must also be in the original packaging, include all materials that came in the packaging. Once the above has been completed OpenAir will provide a refund of the OpenAir Breathe Device price you paid. In any event shipping costs borne by User for products which have already been shipped to User, will not be reimbursed or refunded. You should consider using a trackable shipping service or purchasing shipping insurance to ensure the returned OpenAir Breathe Device is not lost during delivery to OpenAir. We do our best to make returns and exchanges as simple as possible. If you are entitled to a refund in accordance with the above, your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment.
IMPORTANT NOTICE TO ALL INTERNATIONAL CUSTOMERS - Please be advised, the country where you reside may require a payment of a customs or VAT fee. We are not responsible or liable for these customs fees if the country in which you reside charges them for release of shipments. Customs, import, and VAT taxes or fees are beyond our control. Any taxes or fees assessed by your country, including fees associated with the collection of these taxes or fees, are solely your responsibility. We will not grant refunds, neither in full, nor in part, for any taxes or fees collected by your country of residence. If you abandon your package at customs instead of paying assessed taxes or fees, once the package is returned to us we will refund your purchase price less the return shipping and handling costs.
